Terms of Service

Welcome to Curiary. By accessing or using our mobile application and web application (collectively, the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
1. Description of Service
Curiary is a personal tasting journal that allows you to rate, track, and discover your preferences across food and beverage categories including cheese, wine, coffee, whiskey, tea, beer, chocolate, olive oil, meat, and non-alcoholic beverages. The Service is available as an iOS mobile application and a web application.
2. Account Registration
To use Curiary, you must:
- Be at least 13 years old (or the minimum age in your jurisdiction)
- Provide accurate account information
- Keep your login credentials secure
- Notify us of any unauthorized account access
You are responsible for all activity that occurs under your account.
3. Subscriptions and Payments
Free Tier
Curiary offers a free tier with core features, including a limit on the number of ratings you can create.
Paid Subscriptions
Curiary offers paid subscription plans that unlock additional features including unlimited ratings, advanced insights, and export capabilities.
- On iOS, subscriptions are billed through Apple’s App Store. On the web, subscriptions are billed through Stripe.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your App Store account settings (iOS) or your account settings on the web.
- No refunds are provided for partial subscription periods, except where required by applicable law.
Price Changes
We may change subscription prices from time to time. We will give you reasonable notice of any price changes before they take effect. Continued use of a paid plan after a price change constitutes acceptance of the new price.
4. User Content
You retain ownership of all content you create in Curiary, including tasting notes, photos, and ratings (“User Content”). By using the Service, you grant us a limited license to store, display, and process your User Content solely to provide the Service to you.
You agree not to upload content that:
- Infringes on others’ intellectual property rights
- Is illegal, harmful, or offensive
- Contains malware or harmful code
- Violates any applicable laws
5. Acceptable Use
You agree not to:
- Use Curiary for any illegal purpose
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Interfere with or disrupt the Service
- Reverse engineer or decompile the application
- Use automated systems (bots, scrapers) to access the Service without permission
- Share your account credentials with others
- Circumvent any usage limits or access restrictions
6. Intellectual Property
The Curiary Service, including its design, features, code, and content (excluding User Content), is owned by L Squared Financial LLC and protected by intellectual property laws. You may not copy, modify, or distribute our application or its content without permission.
7. Data and Privacy
Your use of Curiary is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
8. Service Availability
We strive to keep Curiary available and functioning, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will provide reasonable notice for significant changes that affect your use of the Service.
9. Disclaimer of Warranties
Curiary is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Curiary is a tool for personal record-keeping and does not provide professional advice about food, beverages, health, or any other matters.
10. Limitation of Liability
To the maximum extent permitted by law, L Squared Financial LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of Curiary.
Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless L Squared Financial LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
You may stop using Curiary and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases, but provisions that should survive (such as limitations of liability, indemnification, and dispute resolution) will remain in effect.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or your use of Curiary shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.
